We operate this website and online store, including all related information, content, features, tools, products, and services, to provide customers with a curated shopping experience (the “Services”). Our store is powered by Shopify.

These Terms of Service (“Terms”) describe your rights and responsibilities when you access or use the Services. By visiting our website, creating an account, or placing an order, you agree to these Terms and our Privacy Policy:

You agree to provide accurate, current, and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You may not transfer, sell, assign, or license your customer account to another person.

SECTION 2 — PRODUCTS

We make reasonable efforts to describe and display our products accurately. However, colours, textures, dimensions, and other visual details may appear differently depending on your device and display settings.

Many products are handmade, naturally derived, or produced in small batches. Minor variations in colour, shape, finish, scent, texture, packaging, or appearance may occur and are not necessarily defects.

Product descriptions, prices, images, availability, and specifications may be changed without notice. We may discontinue products or limit quantities at our discretion.

SECTION 3 — WELLNESS AND PRODUCT INFORMATION

Product descriptions and other content on our website are provided for general informational purposes only. Nothing on this website is intended to diagnose, treat, cure, or prevent any disease or replace advice from a qualified healthcare professional.

Always review product ingredients, warnings, instructions, and suitability before use. Customers are responsible for checking ingredients and allergen information before purchasing or using consumable, beauty, wellness, bath, or personal-care products.

Discontinue use and seek appropriate professional advice if you experience an adverse reaction.

SECTION 4 — ORDERS

Submitting an order constitutes an offer to purchase. An order is not accepted until payment is authorized and we confirm acceptance.

We may decline, limit, modify, or cancel an order because of product availability, pricing or description errors, suspected fraud, supplier restrictions, shipping limitations, or other legitimate reasons.

If we cancel an order after payment has been collected, we will issue an appropriate refund.

Please review your order carefully before submitting it. Once an order has entered supplier fulfillment, changes or cancellations may not be possible.

SECTION 5 — PRICES, CURRENCY, AND PAYMENT

Prices and promotions may change without notice. The amount charged will be the price displayed at checkout when the order is submitted.

Canadian customers generally see prices in Canadian dollars. U.S. customers may see prices in U.S. dollars. The currency shown at checkout is the currency in which the transaction will be processed.

Unless expressly stated otherwise, product prices do not include shipping, duties, import charges, or applicable taxes.

You agree to provide accurate and complete billing and payment information and confirm that you are authorized to use the selected payment method.

SECTION 6 — SHIPPING AND DELIVERY

Products may be fulfilled and shipped directly by independent suppliers. An order containing multiple products may arrive in separate packages, from different locations, or on different dates.

Shipping rates and available delivery methods are displayed at checkout. Delivery dates are estimates and are not guaranteed.

We are not responsible for delays caused by carriers, customs processing, weather, labour disruptions, incorrect addresses, or other circumstances outside our reasonable control. We will assist customers with delayed or missing shipments whenever reasonably possible.

SECTION 7 — RETURNS AND REFUNDS

Returns, exchanges, damaged items, cancellations, and refunds are governed by our Return and Refund Policy:

Customers must contact support@theultimatefindco.com before returning an item. Products may be fulfilled by different suppliers and must be returned to the address provided in the approved return instructions.

Items returned without authorization or sent to an incorrect address may not be accepted or refunded.

SECTION 8 — INTELLECTUAL PROPERTY

The Services—including our store name, branding, logos, text, design, graphics, images, videos, and other content—are owned by or licensed to The Ultimate Find Co. and are protected by Canadian and international intellectual-property laws.

You may use the Services only for personal, non-commercial purposes. You may not reproduce, copy, modify, publish, distribute, sell, exploit, scrape, or create derivative works from our content without prior written permission.

Supplier trademarks, product images, and other third-party materials remain the property of their respective owners.

SECTION 9 — THIRD-PARTY SERVICES AND LINKS

The Services may include links, tools, payment options, applications, or content supplied by third parties.

We do not control all third-party services and are not responsible for their independent terms, privacy practices, availability, or content. Review the applicable third-party policies before using those services.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

The Ultimate Find Co. is powered by Shopify, which enables us to provide the Services.

Sales made through our store are transactions directly between the customer and The Ultimate Find Co. Shopify is not the seller of the products and is not responsible for injury, damage, or loss arising from products purchased from our store.

SECTION 11 — PRIVACY

Because Shopify hosts the Services, Shopify and other service providers may process information in Canada, the United States, or other jurisdictions to provide and improve the Services.

If you submit a review, photograph, suggestion, testimonial, or other feedback, you confirm that you have the right to provide it and that it is accurate and lawful.

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates, or availability.

We may correct errors, update information, or cancel affected orders. If an order is cancelled after payment, we will issue an appropriate refund.

SECTION 16 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services and products are provided on an “as available” and “as is” basis, except for rights, guarantees, and warranties that cannot legally be excluded.

We do not guarantee that the website will always be uninterrupted, secure, or error-free.

Nothing in these Terms excludes or limits any non-waivable rights available under applicable consumer-protection legislation.

SECTION 17 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, The Ultimate Find Co. and its service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the Services or products.

This limitation does not apply where liability cannot legally be excluded or limited, including rights and remedies available under applicable consumer-protection laws.

SECTION 18 — INDEMNIFICATION

You agree to indemnify and hold harmless The Ultimate Find Co., Shopify, and our respective affiliates, employees, contractors, agents, licensors, and service providers from third-party claims, losses, liabilities, and reasonable legal expenses arising from:

  • Your material breach of these Terms

  • Your unlawful use of the Services

  • Your violation of another person’s rights

This obligation applies only to the extent permitted by applicable law.

SECTION 19 — SEVERABILITY

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and severed where necessary. The remaining provisions will continue in effect.

SECTION 20 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce a provision does not waive our right to enforce it later.

These Terms and the policies referenced in them constitute the entire agreement governing your use of the Services and supersede prior discussions or communications concerning the same subject matter.

SECTION 21 — ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our written consent.

We may transfer our rights and obligations as part of a reorganization, sale, merger, business transfer, or other lawful transaction.

These Terms and any separate agreements through which we provide the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Subject to applicable consumer-protection laws, the parties submit to the jurisdiction of the courts of Ontario.
